Terms of Use

Diet Calorie AI: Food Tracker · Effective October 20, 2026

These Terms of Use (“Terms”) govern your use of the Diet Calorie AI: Food Tracker mobile application (the “App”) developed by Serhii Udielov (“we”, “us”). By installing or using the App you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the App.

1. Who can use the App

You must be at least 13 years old. If you are under the age of majority in your country, you may use the App only with the involvement of a parent or guardian, who agrees to these Terms on your behalf.

2. Not medical advice

The App helps you track calories, macronutrients and water and provides general information about foods. It is not a medical device and does not provide medical, nutritional or dietary advice. Calorie and macronutrient targets are estimates calculated from standard formulas and the data you enter; they may not suit your health needs.

Consult a doctor or a qualified dietitian before changing your diet, especially if you are pregnant or breastfeeding, under 18, have or have had an eating disorder, or have a medical condition. Stop using the App and seek professional help if tracking food causes you distress.

3. Nutrition data

Nutrition values in the food catalog, for scanned products and the Nutri-Score grades are provided for information only and may be incomplete or inaccurate. Always check the label of the product. Product information for scanned barcodes comes from Open Food Facts, available under the Open Database License; individual contents of the database are available under the Database Contents License. Product photos from Open Food Facts are made by its contributors and available under the Creative Commons Attribution-ShareAlike 3.0 license.

4. AI assistant Hoshi

Hoshi is an AI assistant that gives automated answers about nutrition, healthy habits and the App, and can estimate a product’s calories and macronutrients from a photo. Its answers are generated by AI models and may be inaccurate, incomplete or inappropriate; they are not medical advice and are not reviewed by a person before you see them. Values estimated from a photo are approximate — check them against the product label.

5. Your account

The App creates an account automatically so your data can be saved and synced; you can also sign in with email or Google. Keep your sign-in details secure — you are responsible for activity in your account. You can delete your account at any time in Settings, as described in the Privacy Policy.

6. Free version, Premium and purchases

6.1 Free version

The App is free to use with ads and some limits, for example a daily number of barcode scans and access to recent history only. We may change free features and limits.

6.2 Premium subscription

6.3 Remove ads

“Remove ads” is a one-time purchase that permanently turns off banner and full-screen ads for your Google Play account. It does not unlock other Premium features. Optional rewarded videos (for example, to get an extra scan) remain available.

6.4 Refunds and restoring purchases

Purchases are processed by Google Play. Refunds are handled under Google Play’s refund policy; you can also contact us. To get your purchases back on a new device, sign in to the same Google Play account and tap “Restore purchases” in the App.

7. Ads

The free version shows ads provided by third-party networks. We are not responsible for the content of ads or for products and websites they lead to.

8. Your content

You keep all rights to the content you add, such as custom products, dishes and photos. You allow us to store and process it only to provide the App to you, for example to sync your diary between devices.

9. Acceptable use

You agree not to misuse the App: not to interfere with its operation or servers, not to access other users’ data, not to use automated means to extract data, and not to copy, modify, reverse engineer or resell the App except where the law allows it.

10. Intellectual property

The App, its design, texts, images and the food catalog are owned by us or our licensors and are protected by law. We grant you a personal, non-exclusive, non-transferable license to use the App on your devices for personal, non-commercial purposes in accordance with these Terms and Google Play’s terms.

11. Changes and availability

We may update the App, add or remove features, or stop providing it. We may update these Terms; the new version will be published on this page with a new effective date, and for significant changes we will notify you in the App. If you continue using the App after changes take effect, you accept the updated Terms.

12. Disclaimer and limitation of liability

The App is provided “as is” and “as available”, without warranties of any kind, to the extent permitted by law. We don’t guarantee that the App will be error-free or uninterrupted, or that nutrition data is accurate.

To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for any health decisions you make based on the App. Our total liability for any claim relating to the App is limited to the amount you paid for the App in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, or your statutory rights as a consumer.

13. Termination

You can stop using the App and delete your account at any time. We may suspend or terminate access if you seriously breach these Terms.

14. Governing law

These Terms are governed by the laws of Ukraine. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in the courts of that country.
